Trademark searches

A trademark search tells you whether your trademark is available and does not infringe earlier rights. Otherwise, you must expect legal measures of third parties (e.g. cease and desist letter or complaint). The trademark offices typically do not check whether your brand or a similar brand is already registered. The omission of a trademark search is classified by the courts as negligent. The costs of a trademark search are very low compared to the potential costs for damages, necessary product renaming, the destruction of already manufactured products, the change of marketing materials, etc. in case of a trademark infringement. Therefore, check whether your desired brand violates any third-party rights beforehand.

Of course, you should perform a search also before using a new company name, a domain name, or the title of a work.
